Platform Terms As of: 9 July 2026 These Platform Terms govern the registration and use of BeautySpaceBooking as well as bookings facilitated through the Platform. BeautySpaceBooking is intended exclusively for entrepreneurs and self-employed professionals. Use as a consumer is not contemplated. This document may be opened, saved, and downloaded at any time. 1. Platform Operator BeautySpaceBooking is operated by: ID Partner GmbH Weyringergasse 15–17/2/2 1040 Wien Österreich Company register number: FN 534464 b VAT identification number: ATU75696702 Managing Director: Ihar Danilchyk E-Mail: support@beautyspacebooking.com Website: beautyspacebooking.com Hereinafter also referred to as "BeautySpaceBooking", "Platform", "we", or "us". 2. Scope These Platform Terms apply to: registration; use of a user account; searching for beauty workspaces; creating and publishing listings; facilitating and managing bookings; communication through the Platform; payment processing; reviews and other user content; other platform services associated with BeautySpaceBooking. For Renters, the Renter Terms apply additionally. For Hosts, the Host Terms apply additionally. For the specific use of a booked beauty workspace, the following also apply: the booking confirmation; the information in the listing; the agreed house rules; the displayed cancellation terms; the Usage Agreement entered into between Renter and Host. 3. Business Use Only BeautySpaceBooking is a B2B platform. The Platform may only be used by: entrepreneurs; self-employed professionals; freelancers; tradespersons; legal entities; persons acting on behalf of a business. Upon registration, the user confirms that they are acting in connection with their self-employed, professional, or commercial activity. Private rentals and bookings for private consumer purposes are not permitted. 4. Definitions 4.1 Host A Host is a registered entrepreneur or self-employed professional who offers a beauty workspace, room, or work area through BeautySpaceBooking. The Host must be entitled to grant the respective beauty workspace for consideration. 4.2 Renter A Renter is a registered entrepreneur or self-employed beauty professional who books a beauty workspace for their professional or commercial activity. 4.3 Beauty Workspace A beauty workspace is a workstation, room, or work area offered through the Platform, in particular: hairdressing station; cosmetics room; make-up station; manicure or pedicure station; brow or lash station; massage or treatment room; salon station; studio; training room; other commercially usable beauty work area. 4.4 Listing A listing is the representation of a beauty workspace published on the Platform by the Host, including description, images, prices, availability, equipment, and terms of use. 4.5 Booking A booking is the bindingly confirmed reservation of a beauty workspace through BeautySpaceBooking. 5. Contractual Relationships Different contractual relationships arise when using the Platform and when making a booking. 5.1 Platform Agreement with the Renter A contract arises between the Renter and ID Partner GmbH regarding: use of the Platform; searching for beauty workspaces; facilitating and managing bookings; booking and payment processing; other platform services. 5.2 Platform Agreement with the Host A contract arises between the Host and ID Partner GmbH regarding: use of the Platform; creating and publishing listings; facilitating Renters; booking management; payment and payout processing; other platform services. 5.3 Usage Agreement between Host and Renter Upon a confirmed booking, a separate contract arises between Host and Renter regarding the time-limited use of the booked beauty workspace. ID Partner GmbH is not a party to this Usage Agreement. The Host is responsible for providing the beauty workspace in accordance with the contract. The Renter is responsible for the proper use of the beauty workspace and for the services they provide to their own customers. 6. Role of BeautySpaceBooking BeautySpaceBooking provides a digital facilitation and booking platform. Platform services include in particular: publication and display of listings; search and filter functions; display of availability; facilitation between Hosts and Renters; booking and payment processing; communication through the Platform; reviews; support with cancellations, complaints, and damage claims. BeautySpaceBooking is generally not: the owner of the beauty workspaces offered; the landlord or sublandlord; the operator of the salons or rooms offered; the employer or principal of a Renter; the provider of beauty services rendered to end customers. This shall not apply only where a beauty workspace is expressly designated as the Host's own listing of ID Partner GmbH. BeautySpaceBooking does not guarantee commercial success, a specific number of bookings, or a specific occupancy rate. 7. Registration and User Account A user account is generally required to offer or book a beauty workspace. The user must: be at least 18 years of age and have legal capacity; act as an entrepreneur or self-employed professional; provide complete and accurate information; keep their data up to date; use secure login credentials; protect their login credentials from unauthorised access; report any suspected misuse without delay. A user account may not be transferred or permanently made available to other persons for use without the consent of BeautySpaceBooking. Multiple accounts created to circumvent: fees; suspensions; verifications; reviews; booking restrictions are not permitted. The user is responsible for all activities carried out through their user account, insofar as they caused or enabled them. 8. Verification BeautySpaceBooking may require information and supporting documents before or during use of the Platform. These may include in particular: proof of identity; company name and business address; company register or commercial register data; VAT or sales tax identification number; trade or professional licence; company documentation; insurance documentation; bank and payout details; proof of entitlement to grant a beauty workspace; information required for tax or legal purposes. BeautySpaceBooking may use public registers and external payment or verification service providers for this purpose. If required information is not provided completely, currently, or accurately, the following may in particular occur: registration may be refused; a listing may not be published; a booking may be prevented; a payout may be suspended; a user account may be restricted may occur. Successful verification does not constitute a guarantee, recommendation, or complete legal review of the user. 9. Listings and User Content Information in a listing must be complete, current, accurate, and not misleading. In particular, the actual characteristics of the beauty workspace must be represented accurately. The following are in particular not permitted: false or misleading descriptions; images that do not adequately represent the actual workspace; unlawful listings; listings without the required right of use; hidden or undisclosed mandatory charges; discriminatory content; third-party content without the required usage rights; contact details intended solely to circumvent the Platform; advertising for services not related to the listing. BeautySpaceBooking may, with respect to listings and content: review them; format them technically or editorially for better presentation; reject them for supplementation; temporarily hide them; not publish them; remove them, if they violate statutory provisions, these Platform Terms, or other applicable contractual terms. BeautySpaceBooking does not alter material substantive information in a listing without the consent of the Host. 10. Rights in User Content The user remains the owner of the rights in the texts, images, videos, and other content provided by them. The user grants BeautySpaceBooking a non-exclusive, territorially unlimited right for the duration of publication to use this content, insofar as this is required for: operation of the Platform; display of the listing; facilitation of bookings; technical adjustments for various devices and formats; search engine display; promotion of the published listing and the Platform. The user confirms that: they hold the required rights; no third-party rights are infringed; persons depicted have consented to publication, insofar as this is required. 11. Search, Filters, and Order of Listings Search results are displayed based on the criteria selected by the user. The order may in particular be influenced by: category; location; booking type; requested period; actual availability; match with the search criteria; price; completeness of the listing; reviews. Confirmed bookings and times blocked by the Host may not be displayed as available. BeautySpaceBooking may further develop the search and display logic, provided users are not misleadingly disadvantaged as a result. 12. Formation of a Booking The Renter selects: the beauty workspace; the booking type; the booking period; where applicable, the time; required additional options. Before the binding booking, the Renter is shown the material booking details and the total amount payable. The booking becomes binding only when: the Renter confirms the booking with obligation to pay; payment or payment authorisation has been successfully confirmed by the payment service provider; BeautySpaceBooking transmits a booking confirmation or makes it available in the user account. A payment that has merely been initiated, failed, or not yet confirmed does not establish a binding booking. Availability may be checked again immediately before completion of payment. Components of the specific booking include in particular: the booking confirmation; the published listing; the booking overview; the booked period; the displayed price; the house rules; the displayed cancellation terms; the Usage Agreement; the applicable Renter and Host Terms. Obvious technical display, pricing, or calculation errors do not give rise to a claim for performance of a recognisably erroneous booking. BeautySpaceBooking will inform the affected users without delay in such a case. 13. Booking Types Beauty workspaces may be booked depending on the respective listing: by the hour; by the day; by the week; monthly. The binding booking period is displayed before the booking with obligation to pay. A monthly booking applies exclusively to the confirmed period. It does not renew automatically and does not constitute a subscription, unless automatic renewal is expressly offered and separately agreed in the future. 14. Prices and Platform Fees The Host sets the price for use of their beauty workspace themselves. BeautySpaceBooking may charge separate platform fees for facilitating and processing a booking. These may include: a service fee charged to the Renter; a commission or platform fee charged to the Host. The applicable fee is clearly displayed to the party obliged to pay before binding conclusion. The Renter is shown in particular before booking: booking price; applicable platform fee; mandatory additional charges; taxes, where applicable; total amount payable. Already confirmed bookings may not be increased unilaterally afterwards. 15. Payment Processing Payments for bookings facilitated through BeautySpaceBooking must be processed through the Platform and the payment service provider used. BeautySpaceBooking uses in particular Stripe and/or Stripe Connect for this purpose. The terms and privacy information of the payment service provider may apply additionally to payment processing. BeautySpaceBooking does not itself provide payment services requiring a licence, insofar as these services are provided by the payment service provider used. Direct cash payments, bank transfers, or other payments outside the Platform are permitted only if BeautySpaceBooking has expressly approved this. There is no entitlement to a specific payment method. 16. Prohibition of Platform Circumvention Hosts and Renters may not circumvent the Platform in order to: avoid platform fees; process payments outside the Platform; circumvent booking rules; avoid reviews or security mechanisms. If contact between Host and Renter was first established through BeautySpaceBooking, resulting bookings for the same or an economically comparable beauty workspace must be processed through BeautySpaceBooking. The circumvention prohibition applies for twelve months from: the first contact established through BeautySpaceBooking; or the last booking carried out through BeautySpaceBooking, whichever point in time is later. In the case of a booking concluded in breach of contract outside the Platform, the platform fees remain due that would have been incurred upon a proper booking through BeautySpaceBooking. BeautySpaceBooking may additionally: assert demonstrable damages; restrict listings; temporarily suspend user accounts; terminate the platform agreement in the event of serious or repeated violations. A business relationship already existing before contact through BeautySpaceBooking does not constitute platform circumvention if it can be demonstrated in a traceable manner. 17. Communication Communication through the Platform must be factual, lawful, and related to the preparation or performance of the booking. The following are in particular not permitted: insults or threats; discriminatory content; spam; fraudulent messages; requests to circumvent the Platform; impermissible advertising; transmission of unlawful content; unnecessary disclosure of third-party personal data. BeautySpaceBooking may review messages to the extent required if: a complaint has been submitted; a security issue exists; there is suspicion of fraud or circumvention; a legal obligation exists; this is required to process a booking or dispute. Routine private evaluation of all messages does not take place. 18. Reviews Reviews may generally only be submitted by users who were involved in an actual booking confirmed through BeautySpaceBooking. Reviews must: be based on personal experience; be truthful; be formulated in a factual manner; relate to the specific booking. The following are in particular not permitted: purchased or manipulated reviews; reviews of one's own or affiliated listings; insults or threats; discriminatory content; confidential personal data; advertising and spam; demonstrably false statements of fact. BeautySpaceBooking may review, temporarily hide, or remove a review if there is reasonable suspicion of a legal or contractual violation. A review is not removed solely because it is negative. 19. Unlawful Content and Reports Users may not publish or transmit unlawful content through BeautySpaceBooking. Reports of unlawful listings, reviews, messages, or other content may be submitted electronically to: support@beautyspacebooking.com A report should where possible include: the specific link or a clear identification of the content; a reason why the content is considered unlawful; appropriate supporting evidence; the name and email address of the reporting person, where required; a statement that the information is correct to the best of their knowledge. BeautySpaceBooking reviews sufficiently specific reports promptly, carefully, and objectively. 20. Moderation and Restrictions BeautySpaceBooking may restrict content, listings, booking functions, or user accounts if there is an objective reason. These include in particular: false or misleading information; missing authorisations; unpaid claims; suspicion of fraud or misuse; platform circumvention; unlawful content or activities; significant safety or hygiene risks; manipulated reviews; repeated unjustified cancellations; serious or repeated contractual violations. Possible measures include: request for correction; rejection or removal of content; restriction of visibility; temporary deactivation of a listing; restriction of individual platform functions; withholding of a payout, insofar as legally and contractually permitted; temporary suspension; termination of the user account. The measure is chosen according to the nature, severity, frequency, and effects of the violation. BeautySpaceBooking may use technical systems to detect spam, fraud, security risks, or possible contractual violations. Material restrictions are not imposed solely by automated means, insofar as human review is legally required. In urgent cases of safety, fraud, or legal risk, a measure may be taken without prior notice. Where legally required, the affected user is informed of the reason and the available complaint options. 21. Complaints against Platform Decisions A user may request review of a decision regarding: removal of content; restriction of a listing; suspension of a user account; restriction of a platform function may request. Complaints may be submitted free of charge to the following address: support@beautyspacebooking.com The complaint should include: the affected user account; the decision complained of; the grounds for the complaint; available supporting evidence. BeautySpaceBooking reviews sufficiently substantiated complaints carefully and not solely by automated means. Statutory options for judicial or extrajudicial enforcement of rights remain unaffected. 22. Availability and Further Development of the Platform BeautySpaceBooking endeavours to provide the Platform reliably and securely. There is no entitlement to availability at all times, without interruption, and entirely free of errors. Temporary restrictions may arise in particular due to: maintenance work; updates; security measures; technical disruptions; failures of external service providers; force majeure; regulatory or statutory requirements. BeautySpaceBooking may change, supplement, or discontinue functions, provided already confirmed bookings are not unreasonably affected as a result. 23. Data Protection Information on the processing of personal data is contained in the BeautySpaceBooking Privacy Policy. Information on cookies and comparable technologies is contained in the Cookie Information. The documents referred to are permanently accessible via the website. 24. Liability of BeautySpaceBooking BeautySpaceBooking is not liable for performance of the Usage Agreement between Host and Renter. In particular, BeautySpaceBooking does not guarantee: the accuracy of user-provided information; the actual availability of a beauty workspace; its condition, equipment, cleanliness, or suitability; the legal entitlement of the Host; the professional or commercial authorisation of a Renter; the quality or lawfulness of beauty services provided; the conduct of Hosts, Renters, customers, or accompanying persons; the commercial success of a booking; the solvency of a user. Claims arising from the actual provision or use of the beauty workspace are generally to be resolved directly between Host and Renter. BeautySpaceBooking is liable without limitation: in cases of intent and gross negligence; for damage to life, body, or health; under mandatory statutory liability. In the event of slight negligence in breach of an essential contractual obligation, liability is limited to the typically foreseeable direct damage. Otherwise, liability for slight negligence is excluded, insofar as this is legally permissible. Insofar as legally permissible, BeautySpaceBooking is not liable for indirect damage, consequential damage, loss of profit, loss of revenue, loss of customers, or business interruption. 25. Indemnification The user shall indemnify ID Partner GmbH against justified third-party claims arising from a legal or contractual violation for which they are responsible. This applies in particular to claims due to: unlawful listings or content; missing usage or publication rights; missing approvals; infringement of copyright, trademark, or personality rights; data protection violations; damage to persons or property; unlawful services rendered to end customers; false information; platform circumvention. The indemnification includes reasonable and necessary costs of legal defence, insofar as this is legally permissible. 26. Term and Termination The platform agreement is concluded for an indefinite term. The user may terminate their user account, provided: no active booking exists; no payment or payout is outstanding; no ongoing damage or complaint matter exists; no statutory retention obligations stand in the way. BeautySpaceBooking may terminate the platform agreement for good cause without observing a notice period. Good cause exists in particular in the event of: serious or repeated contractual violations; fraud or attempted fraud; platform circumvention; unlawful use; false identity or company information; significant safety risks; repeated non-payment of due claims. Payment, fee, or damage claims already incurred remain unaffected by termination of the user account. 27. Statutory Tax and Platform Reporting BeautySpaceBooking may be legally obliged regarding information on: users; listings; bookings; revenue; payouts; platform fees to collect, review, retain, and transmit to the competent authorities. The user is obliged to provide the information required for this purpose completely, currently, and accurately. If required information is missing, bookings, listings, or payouts may be restricted until the matter is clarified. 28. Amendments to these Platform Terms BeautySpaceBooking may amend these Platform Terms if this is required for: legal; technical; security-related; economic; organisational reasons. Registered users are generally informed electronically of material amendments at least 30 days before the planned effective date. A shorter period may apply if the amendment is required due to: mandatory statutory requirements; regulatory orders; urgent security measures; prevention of fraud or misuse. For already confirmed bookings, the terms applicable at the time of booking generally apply. In the case of material amendments, renewed active consent may be required. 29. Applicable Law and Jurisdiction Austrian law applies to the platform agreement between the user and ID Partner GmbH, excluding: conflict-of-law rules; the UN Convention on Contracts for the International Sale of Goods. For disputes between ID Partner GmbH and an entrepreneur, the exclusive jurisdiction of the competent court in Vienna is agreed, insofar as legally permissible. For the Usage Agreement between Host and Renter, mandatory provisions of the state in which the booked beauty workspace is located may additionally apply. 30. Contract Language and Final Provisions The authoritative contract language is German. Translations may be provided in English and Spanish. In the event of discrepancies or contradictions, the German version shall prevail, insofar as mandatory law does not provide otherwise. Should any provision of these Platform Terms be wholly or partly invalid or unenforceable, the remaining provisions shall remain effective. An invalid provision shall be replaced by the applicable statutory provisions. These Platform Terms are made available before conclusion of the contract in such a way that they can be opened, saved, and reproduced. 31.
