Renter Terms

These Renter Terms govern the booking and use of beauty workspaces by businesses and self-employed beauty professionals.

They apply in addition to the Platform Terms and the terms of the respective booking.

This document may be opened, saved, and downloaded at any time.

1. Platform operator

Hereinafter also referred to as "BeautySpaceBooking", "Platform", "we" or "us".

2. Scope and contractual components

These Renter Terms apply to businesses and self-employed persons who book a beauty workspace via BeautySpaceBooking or submit a booking request.

They apply in addition to the Platform Terms. For the specific booking, the following also apply:

  • the booking confirmation;
  • the information in the offer;
  • the confirmed booking period;
  • the prices and fees displayed before booking;
  • the house rules and usage restrictions;
  • the cancellation terms displayed before booking;

the usage agreement concluded between Renter and Host.

Individual information in the booking confirmation takes precedence over these Renter Terms insofar as it has been validly agreed. The Platform Terms remain additionally applicable for the use of BeautySpaceBooking.

The Renter agrees to these terms electronically. BeautySpaceBooking may document the accepted version, the time of consent, and the assignment to the user account.

3. Business use only

The Renter is exclusively a business, self-employed person, or company that books a beauty workspace for a professional or commercial activity.

The Renter confirms that they are not acting for private consumer purposes. Where a person acts on behalf of a business, they must be authorised to make the required declarations.

4. Registration and user account

A user account is generally required for a booking. The Renter must:

  • be at least 18 years of age and have legal capacity;
  • provide complete and accurate information;
  • keep their business and contact details up to date;
  • keep their access credentials secure;

report unauthorised access or misuse of the account without undue delay.

The user account may not be transferred or permanently used by unauthorised third parties without the consent of BeautySpaceBooking.

5. Verification

BeautySpaceBooking may require appropriate evidence before or during use of the Platform, in particular regarding:

  • identity and authority to represent;
  • business status;
  • trade or professional authorisation;
  • business and tax data;
  • insurance coverage;

payment and invoicing data.

If required information is not provided completely, is not current, or cannot be verified, BeautySpaceBooking may restrict a booking, payment, or account use until the matter is clarified.

Verification does not constitute a guarantee or recommendation of the Renter by BeautySpaceBooking.

6. Role of BeautySpaceBooking and contractual relationships

BeautySpaceBooking provides a digital brokerage, booking, and payment platform.

Upon a confirmed booking, a separate usage agreement arises between the Renter and the Host regarding the temporary use of the booked beauty workspace. ID Partner GmbH is not a party to this usage agreement.

The Host is responsible for providing the beauty workspace in accordance with the contract. The Renter is responsible for its proper use and for the services they provide to their own customers.

7. Review of an offer

Before booking, the Renter must review the information material to their activity, in particular:

  • category and type of beauty workspace;
  • location area;
  • equipment and available devices;
  • permitted and excluded activities;
  • access and usage times;
  • house, hygiene, and cleaning rules;
  • booking price, platform fee, and mandatory additional costs;
  • security deposit, where applicable;

cancellation terms.

Before booking, the Renter must clarify whether the beauty workspace is legally and factually suitable for their specific activity.

8. Booking types and booking period

A beauty workspace may be booked depending on the offer:

  • by the hour;
  • by the day;
  • by the week;

monthly.

For an hourly booking, the confirmed times apply. A day booking applies to the selected calendar day within the access times specified in the offer.

A week booking generally comprises seven consecutive calendar days from the selected start date.

A month booking applies for the period confirmed in the booking overview. It begins on the selected start date and generally ends on the day before the corresponding date in the following month. A month booking is therefore not automatically fixed at 31 days.

Month bookings do not renew automatically and are not a subscription, unless automatic renewal is expressly offered and separately agreed in the future. Separately, a host may offer long-term rental with monthly Stripe recurring charges; stop-billing conditions are shown at checkout.

9. Formation of a booking

Depending on the Host's settings, a booking may be made as an instant booking or as a booking request.

9.1 Instant booking

For an instant booking, the booking becomes binding when the Renter confirms the chargeable booking, payment or payment authorisation has been successfully confirmed, and BeautySpaceBooking provides a booking confirmation.

9.2 Booking request

For a booking request, the booking becomes binding only when the Host has accepted the request, the required payment or payment authorisation has been successfully confirmed, and BeautySpaceBooking provides a booking confirmation.

A payment that has been initiated, failed, or not yet confirmed does not establish a binding booking. Availability may be checked again immediately before confirmation.

10. Prices and Renter service fee

The Host sets the booking price for the beauty workspace.

BeautySpaceBooking may charge a separate Renter service fee for brokerage, booking processing, and platform use. The specific amount is clearly displayed before the chargeable booking.

Before booking, the Renter is shown in particular:

  • the booking price;
  • the Renter service fee;
  • mandatory additional costs;
  • taxes, where applicable;
  • a security deposit, where applicable;

the total amount payable.

Confirmed bookings may not be unilaterally increased in price afterwards.

11. Payment processing

Payments for bookings brokered via BeautySpaceBooking must be processed via the Platform and the payment service provider used.

BeautySpaceBooking uses in particular Stripe and/or Stripe Connect for this purpose. In addition, the terms and privacy information of the payment service provider may apply.

Direct cash payments, bank transfers, or other payments outside the Platform are permitted only if BeautySpaceBooking has expressly approved them.

There is no entitlement to a specific payment method. If a payment fails or is rejected, the booking may not be confirmed or may be cancelled.

12. Invoices and taxes

The Host issues the Renter an invoice for the booking price and the mandatory additional costs due to the Host.

ID Partner GmbH issues the Renter a separate invoice for the Renter service fee and, where applicable, further platform services displayed before booking.

The Renter is solely responsible for the tax treatment of their expenses, services, and cross-border transactions. BeautySpaceBooking does not provide tax advice.

13. Full address and access information

Before a confirmed booking, only the city or an approximate location area may be displayed.

The full address and the access information required for use are generally provided only after successful payment and confirmed booking.

The Renter may use access credentials, keys, codes, and non-public location information only for the confirmed booking and may not disclose them to unauthorised third parties.

14. Cancellation by the Renter

For a booking, the cancellation terms apply that the Host has set for the respective offer and that BeautySpaceBooking has displayed to the Renter before the chargeable booking.

The displayed cancellation terms determine in particular:

  • whether a booking may be cancelled;
  • by what time cancellation is possible;
  • which amounts are refunded or retained;

how no-shows, late arrival, or early departure are treated.

A subsequent change to the cancellation terms to the detriment of an already confirmed booking is not permitted.

Whether and to what extent the booking price, Renter service fee, additional costs, or security deposit are refunded is determined by the cancellation overview displayed before booking and mandatory statutory provisions.

15. Cancellation by the Host

If the Host cancels a confirmed booking or cannot provide the beauty workspace in accordance with the contract, the Renter is generally refunded in full:

  • the booking price paid via BeautySpaceBooking;
  • the Renter service fee;
  • paid mandatory additional costs;

an already paid or reserved security deposit, insofar as it has not otherwise been lawfully applied.

BeautySpaceBooking may assist the Renter in searching for a replacement booking but does not owe a replacement booking and does not guarantee an equivalent or equally priced replacement.

Further claims against the Host remain unaffected. Claims against BeautySpaceBooking are governed by the Platform Terms and mandatory statutory provisions.

16. Scope of the right of use and booking time

The Renter receives only for the confirmed booking period a limited, non-transferable right to use the booked beauty workspace for the agreed purpose.

The booking time also includes preparation, setup, cleaning, dismantling, and timely departure from the beauty workspace.

Use before the start or after the end of the confirmed period, transfer to third parties, subletting, or other disclosure is not permitted without the express consent of the Host and BeautySpaceBooking.

17. Duties of the Renter

The Renter is in particular obliged to:

  • use the beauty workspace only for the confirmed purpose;
  • comply with house rules, access requirements, and usage restrictions;
  • comply with hygiene, safety, trade, and other applicable regulations;
  • use only safe, permitted, and professionally maintained products and devices;
  • not unreasonably impair other users, neighbours, and visitors;
  • treat the beauty workspace and inventory with care;
  • report damage, defects, and safety risks without undue delay;

return the beauty workspace on time, in good order, and in accordance with the agreed cleaning rules.

18. Own customers and accompanying persons

The Renter acts towards their own customers entirely independently, in their own name, and on their own account.

The Renter is in particular responsible for:

  • the professional and legal permissibility of their services;
  • advice, information, and required consents;
  • health prerequisites and contraindications;
  • products, materials, and devices used;
  • protection of customer data;
  • prices, invoices, and complaints;

the conduct of their customers, employees, assistants, models, and accompanying persons.

Neither the Host nor BeautySpaceBooking become contracting parties of the Renter's end customers solely by reason of the booking.

19. Authorisations and insurance

The Renter must hold all trade, professional, and other authorisations required for their activity during use.

The Renter must maintain professional or business liability insurance appropriate to their activity and use of third-party business premises. Where relevant, product and treatment risk must also be covered.

BeautySpaceBooking or the Host may require current evidence. If evidence cannot be provided, a booking may be rejected, restricted, or cancelled insofar as this is objectively justified.

20. House rules and excluded activities

The Renter must comply with the house, safety, hygiene, access, and cleaning rules accessible before booking.

The following are in particular not permitted:

  • activities expressly excluded in the offer;
  • unlawful or unauthorised activities;
  • medical, invasive, or particularly regulated services where the beauty workspace is not expressly suitable and authorised for them;
  • dangerous alterations to rooms, connections, or fixtures;
  • disclosure or duplication of keys and access codes;
  • storage of hazardous substances outside the expressly permitted scope;

use that endangers persons, property, or operations.

21. Defects, disruptions, and on-site complaints

The Renter must report material defects, lack of access, or a significant deviation from the offer to the Host without undue delay and via the Platform.

Where reasonable, the Renter must give the Host an opportunity to remedy the defect within a reasonable time.

The Renter should document the condition with appropriate evidence, in particular through photos, videos, messages, or a precise description.

If the Renter leaves the beauty workspace or independently arranges a replacement solution without first reporting a remediable defect, this may make it more difficult to review a refund.

22. Damage, additional cleaning, and security deposit

The Renter is liable under statutory provisions for culpably caused damage and additional cleaning costs arising from them or persons within their sphere of responsibility. Normal wear and tear does not constitute damage.

The Renter must report damage without undue delay and cooperate in its clarification.

The Host may set a security deposit where its amount and conditions are clearly displayed before booking. The specific method of reservation, payment, release, or direct processing is shown in the booking process.

BeautySpaceBooking may assist with communication and processing but is not obliged to acknowledge, pay, or enforce a claim.

23. Prohibition of platform circumvention

The Renter may not circumvent BeautySpaceBooking to avoid platform fees, payment processing, security mechanisms, or booking rules.

If contact with the Host was first established via BeautySpaceBooking, bookings for the same or an economically comparable beauty workspace must be processed via BeautySpaceBooking.

The circumvention prohibition applies for twelve months from the first contact via the Platform or the last booking processed via BeautySpaceBooking, whichever point in time is later.

A business relationship already existing before platform contact is not considered circumvention if it can be substantiated.

24. Communication and reviews

Communication must be factual, respectful, and related to the preparation or performance of a booking. Insults, threats, discrimination, spam, and requests to circumvent the Platform are not permitted.

The Renter may submit a truthful and factual review after an actual booking confirmed via BeautySpaceBooking.

The following are in particular not permitted: manipulated reviews, demonstrably false statements of fact, confidential personal data, insults, and threats.

25. Restriction and termination of the user account

BeautySpaceBooking may restrict a user account or individual functions for objective reasons, in particular in cases of:

  • false or unverifiable information;
  • missing authorisations or insurance evidence;
  • payment problems or chargebacks;
  • suspected fraud or misuse;
  • platform circumvention;
  • material safety, hygiene, or legal violations;

serious or repeated breaches of contractual terms.

The Renter may close their user account as soon as no active bookings, outstanding payments, chargebacks, damage cases, or disputes remain.

Claims already arisen and statutory retention obligations remain unaffected by account closure.

26. Liability

The Host is responsible for providing the beauty workspace in accordance with the contract, its condition, safety, and the equipment promised in the offer.

The Renter is responsible for their activity, their customers, their products, devices, and the proper use of the beauty workspace.

BeautySpaceBooking is liable for its own obligations in accordance with the Platform Terms and mandatory statutory provisions. BeautySpaceBooking in particular does not guarantee the professional suitability of a user, the commercial success of a booking, or performance of the usage agreement by Host or Renter.

27. Indemnification

The Renter shall indemnify ID Partner GmbH against justified third-party claims arising from a legal or contractual breach for which they are responsible.

This concerns in particular claims due to:

  • unlawful or professionally impermissible services;
  • missing authorisations or insurance;
  • damage to persons or property;
  • violations of data protection, copyright, trademark, or personality rights;
  • acts of their own customers, employees, or accompanying persons;

platform circumvention.

The indemnification includes reasonable and necessary costs of legal defence insofar as this is permitted by law.

28. Data protection

Information on the processing of personal data is contained in the Privacy Policy of BeautySpaceBooking.

The Renter is solely responsible for processing the data of their own customers and may not transmit unnecessary health, treatment, or other specially protected customer data via the Platform.

29. Amendments to these Renter Terms

BeautySpaceBooking may amend these Renter Terms for legal, technical, security-related, economic, or organisational reasons.

Registered users are generally informed electronically of material amendments before they take effect. For already confirmed bookings, the terms applicable at the time of booking generally apply.

For material amendments, renewed active consent may be required.

30. Applicable law, contract language, and final provisions

Austrian law applies to the platform agreement between the Renter and ID Partner GmbH, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

For disputes between ID Partner GmbH and a business, the exclusive jurisdiction of the competent court in Vienna is agreed insofar as permitted by law.

For the usage agreement between Renter and Host, mandatory provisions of the state in which the beauty workspace is located may additionally apply.

The authoritative contract language is German. Translations may be provided in English and Spanish. In case of discrepancies, the German version prevails insofar as mandatory law does not provide otherwise.

Should any provision be wholly or partly invalid, the remaining provisions remain effective. The invalid provision is replaced by the applicable statutory provisions.
