Host Terms

These Host Terms govern the offering, rental, and management of beauty workspaces via BeautySpaceBooking. They apply in addition to the Platform Terms and the terms of the respective booking. This document may be opened, saved, and downloaded at any time.

BeautySpaceBooking is operated by:

Hereinafter also referred to as "BeautySpaceBooking", "Platform", "we" or "us".

These Host Terms apply to businesses and self-employed persons who offer beauty workspaces, rooms, or work areas via BeautySpaceBooking. They apply in addition to the Platform Terms. For a specific booking, the following also apply:

the booking confirmation

the published offer

the confirmed booking period

the displayed prices and fees

the house rules and usage restrictions

the cancellation terms displayed before booking

the usage agreement concluded between Host and Renter.

The Host agrees to these terms electronically before publishing their first offer. BeautySpaceBooking may document the accepted version, the time of consent, and the assignment to the user account.

Only businesses and persons demonstrably acting as businesses or self-employed persons are permitted as Hosts.

The Host confirms that all offers and bookings are made in the course of their professional or commercial activity. Private providers are not permitted. Where a person acts on behalf of a business, they must be authorised to conclude the platform agreement and manage offers.

BeautySpaceBooking provides a digital brokerage, booking, and payment platform.

The agreement on the temporary use of a beauty workspace is concluded exclusively between Host and Renter. ID Partner GmbH is not a party to this usage agreement. The Host remains responsible for providing the beauty workspace in accordance with the contract. BeautySpaceBooking does not owe its actual provision, a specific number of bookings, a specific occupancy rate, or a specific revenue.

The Host must provide complete, accurate, and current business, contact, tax, bank, and location data.

BeautySpaceBooking may require in particular the following evidence:

identity and authority to represent

company register, commercial register, or trade evidence

VAT or sales tax identification number

bank and payout data

information on beneficial owners

insurance evidence

ownership, lease, tenancy, or usage evidence

consents of owners or principal landlords

official permits.

If information is missing, false, or cannot be verified, BeautySpaceBooking may restrict offers, bookings, payments, or payouts until the matter is clarified. Verification does not constitute a guarantee, recommendation, or complete legal review of the Host or their beauty workspace.

The Host guarantees that they are authorised to grant each offered beauty workspace for use for consideration.

The Host confirms in particular that:

they are the owner, principal tenant, lessee, or otherwise authorised user

all required consents are in place

the grant of use does not breach existing agreements

the offered commercial use is permitted

no official prohibition or ban on use exists

the rights of owners, neighbours, or other third parties are not infringed.

BeautySpaceBooking may require evidence but is not obliged to review all prerequisites in full.

The Host is responsible for ensuring that the beauty workspace and its grant of use for consideration comply with applicable legal, contractual, and official requirements. This concerns in particular:

trade, lease, tenancy, and usage law

building, fire protection, and safety regulations

hygiene and health requirements

employee protection and accident prevention

noise, waste, and house rules requirements

data protection

local and official provisions. Material changes, official measures, prohibitions, or safety problems must be reported to BeautySpaceBooking without undue delay.

The Host must maintain insurance coverage appropriate to the operation and grant of use for consideration of the beauty workspace.

The insurance coverage should in particular include business liability as well as risks towards Renters, customers, visitors, and third parties. BeautySpaceBooking may require current insurance evidence. If evidence cannot be provided, an offer may be rejected, restricted, or deactivated. BeautySpaceBooking is not an insurer or insurance intermediary.

The Host must provide all offer and business information completely, currently, accurately, and not misleadingly.

The offer must in particular clearly show:

type and category of beauty workspace

city and location area

size, room layout, and material characteristics

equipment, furniture, and available devices

permitted and excluded activities

access and usage times

maximum number of persons, where relevant

house, hygiene, and cleaning rules

booking prices for the offered booking types

mandatory additional costs

security deposit, where applicable

cancellation terms

material usage restrictions. Hidden or mandatory costs communicated only after booking are not permitted.

Photos, videos, and descriptions must adequately reflect the actual and current condition of the beauty workspace.

The Host may provide only content to which they hold the required rights. Where persons, brands, artworks, or other protected content are recognisable, the Host must hold the required consents and usage rights. The Host grants BeautySpaceBooking a non-exclusive, territorially unlimited right for the duration of publication to store, technically adapt, display, and use the content to promote the offer and the Platform. BeautySpaceBooking may format content technically or editorially but may not change material factual information without the Host's consent.

The Host may not use content in the offer or in platform messages that promotes booking or payment outside BeautySpaceBooking. The following are in particular not permitted:

direct contact details for the purpose of platform circumvention

external booking links

payment details for direct payment

requests for cash payment or direct bank transfer

references to cheaper direct bookings

links to competing booking platforms insofar as they serve circumvention.

BeautySpaceBooking may remove such information and restrict the offer until corrected.

The Host must keep the calendar up to date at all times. Already occupied, closed, or otherwise unavailable times must be blocked without undue delay. Manual blocks and confirmed bookings must be taken into account for all offered booking types.

The Host bears responsibility for double bookings, outdated availability, incorrect opening hours, delayed provision, and organisational errors within their sphere of responsibility.

Depending on the beauty workspace, the Host may offer the following booking types:

by the hour

by the day

by the week

monthly.

A week booking generally comprises seven consecutive calendar days from the confirmed start date.

A month booking applies for the period confirmed in the booking overview and generally ends on the day before the corresponding date in the following month. It does not renew automatically and is not a subscription. Depending on the available platform function, the Host may activate instant bookings, booking requests, or both models.

Where instant booking is activated, the booking becomes binding when the Renter confirms the chargeable booking, payment or payment authorisation has been successfully confirmed, and BeautySpaceBooking provides the booking confirmation.

An additional individual confirmation by the Host is not required.

For a booking request, the Host may accept or reject the request within the displayed period. The booking becomes binding only after acceptance, successful payment confirmation, and provision of the booking confirmation.

The Host must fulfil confirmed bookings in accordance with the offer.

The Host sets the booking price themselves and must keep their price and tax information complete and accurate.

The Host must in particular specify:

which price applies per hour, day, week, or month

whether VAT is included in the price

which VAT rate applies or whether a tax exemption or small business scheme applies

which mandatory additional costs apply

whether and in what amount a security deposit is provided.

The price displayed before conclusion of the booking is binding for the confirmed booking. A subsequent unilateral increase is not permitted.

For each booking brokered via BeautySpaceBooking and validly confirmed, the Host pays ID Partner GmbH a brokerage commission of 10% of the Host booking value. Statutory VAT is calculated on the commission where applicable. The Host booking value comprises:

the booking price for the beauty workspace

mandatory cleaning or additional costs due to the Host

other mandatory services booked via the Platform and due to the Host. Not included in the Host booking value are:

the Renter service fee of BeautySpaceBooking

a refundable security deposit

amounts fully forwarded to third parties and not due to the Host.

The commission claim generally arises upon valid formation of the booking. The commission is deducted from booking proceeds before payout. A deviating commission applies only if it has been expressly and electronically agreed between BeautySpaceBooking and the Host.

All bookings brokered via BeautySpaceBooking must be paid via the Platform and the payment service provider used.

The Host authorises BeautySpaceBooking and the payment service provider used to receive payments from the Renter for confirmed bookings on behalf of and for the account of the Host, settle them, and pay them out after deduction of the commission owed. For payment and payout processing, the Platform Terms, payout information displayed in the Host account, and the terms of the payment service provider may additionally apply. BeautySpaceBooking may temporarily withhold a payout insofar as this is required for review or safeguarding, in particular if:

a payment has not yet been finally confirmed

a cancellation, complaint, or damage report is outstanding

a chargeback, fraud, or circumvention is suspected

required identity, tax, bank, or business data is missing

a statutory or official obligation exists. Actual credit to the account may depend on bank, country, currency, and payment service provider.

The Host issues the Renter a proper invoice for the booking price and the mandatory additional costs due to the Host. ID Partner GmbH issues the Host a separate invoice for the Host commission and, where applicable, further expressly agreed platform services. Where commissions have already been withheld from booking proceeds, they are deemed paid by set-off. If an amount owed cannot be fully set off, it must be paid within the period stated on the invoice, or in the absence of such a statement within 14 days of the invoice date.

The Host agrees to electronic provision of invoices in the user account or by email. The Host is responsible for the accuracy of their tax, invoicing, and business information and for the proper declaration and payment of their taxes and levies. BeautySpaceBooking does not provide tax advice.

The Host must provide the beauty workspace at the confirmed time:

available

clean

safe

accessible

functional

equipped in accordance with the offer

provide.

The Host must provide the Renter in good time with the full address and the required access information, keys, or codes. BeautySpaceBooking may transmit or display this information after successful payment and confirmed booking. All offered devices and fixtures must be safe, functional, and suitable for the stated use.

The Host may set reasonable house, safety, hygiene, access, and cleaning rules. These must be clearly accessible before booking.

The Host must clearly state which activities are permitted or excluded. House rules and usage restrictions may not be changed afterwards to the detriment of an already confirmed booking. Particularly regulated, invasive, medical, or health-related activities may be permitted only if the beauty workspace is legally and factually suitable for them. The professional authorisation of the Renter remains their own responsibility.

The Host sets the permitted cancellation terms for their offer.

Only the terms displayed to the Renter before the chargeable booking apply. The cancellation terms must clearly determine:

whether a booking may be cancelled

by what time cancellation is possible

which amounts are refunded or retained upon cancellation

how no-shows, late arrival, or early departure are treated.

A subsequent change to the detriment of already confirmed bookings is not permitted.

The Host may cancel a confirmed booking only if they cannot provide the beauty workspace in accordance with the contract or a material objective reason exists.

Upon cancellation by the Host, the Renter generally receives a full refund of the booking price paid via BeautySpaceBooking, the Renter service fee, paid mandatory additional costs, and an already paid or reserved security deposit. If the Host is responsible for the cancellation or non-performance, the Host commission of 10% of the Host booking value plus statutory VAT remains owed. This applies in particular in cases of:

double booking or outdated calendar

own use or other use

acceptance of another booking

lack of preparation or lack of access

missing consents or permits

other organisational reasons within the Host's sphere of responsibility.

In the event of a proven, unforeseeable occurrence for which the Host is not responsible, BeautySpaceBooking may waive the commission wholly or partly after review. There is no automatic entitlement thereto insofar as mandatory law does not provide otherwise. Repeated or unjustified cancellations may lead to restriction of visibility, deactivation of the offer, or suspension of the user account.

The Host may set a security deposit where amount, purpose, and conditions are clearly displayed before booking. The specific method of reservation, payment, release, or direct processing is shown in the booking process. Damage or extraordinary cleaning costs must be reported via the Platform without undue delay after discovery and adequately documented, in particular through photos, videos, description, and appropriate cost receipts.

Normal wear and tear does not constitute damage. BeautySpaceBooking may assist with communication and processing but does not guarantee acknowledgement, payment, or enforcement of a claim.

The Host must treat Renters fairly, objectively, respectfully, and without discrimination.

The Renter provides their beauty services to their own customers independently and on their own responsibility. The Host does not become a contracting party of these end customers solely by reason of the booking. The Host nevertheless remains responsible for the safety and contractual condition of the rooms, fixtures, and devices provided by them.

The Host may not circumvent BeautySpaceBooking to avoid commissions, payment processing, security mechanisms, or platform rules. If contact with a Renter was first established via BeautySpaceBooking, resulting bookings for the same or an economically comparable beauty workspace must be processed via BeautySpaceBooking.

The circumvention prohibition applies for twelve months from the first contact via the Platform or the last booking processed via BeautySpaceBooking, whichever point in time is later. For a booking concluded outside the Platform in breach of contract, the Host commission remains owed on the basis of the actually agreed booking value. If this cannot be established, a substantiated market-standard booking value may be used. A business relationship already existing before platform contact is not considered circumvention if the Host can substantiate it.

The order and visibility of offers may be influenced in particular by:

category and geographical match

selected search criteria

booking type and availability

price

completeness and currency of the offer

reviews

safety and complaint status.

There is no entitlement to a specific position, visibility, number of enquiries, or number of bookings.

Communication with Renters and BeautySpaceBooking must be factual, respectful, and related to the preparation or performance of a booking.

The Host accepts that Renters may submit a truthful and factual review after an actual booking, even if it is critical or negative. The Host may respond to reviews objectively and report unlawful or demonstrably false content. There is no entitlement to removal of a permissible negative review. Threats, pressure, insults, or impermissible contact regarding a review are not permitted.

If BeautySpaceBooking forwards a complaint, damage report, or payment request, the Host must:

respond within a reasonable period

provide requested information and evidence

cooperate in an appropriate solution

inform BeautySpaceBooking of material developments.

BeautySpaceBooking may provide mediating support between Host and Renter but is not obliged to render a final decision in a private-law dispute.

BeautySpaceBooking may restrict or suspend offers, booking functions, communication, payments, or payouts for objective reasons. These include in particular:

false or misleading information

missing verification or authority to grant use

safety or hygiene deficiencies

unpaid commissions or outstanding claims

chargebacks, suspected fraud or circumvention

repeated or unjustified cancellations

unlawful content or activities

data protection violations or infringements of third-party rights

serious or repeated breaches of contract.

In urgent safety, fraud, or legal risks, a measure may be taken without prior notice. Where required, the Host is informed of the reason and a complaint option.

no active or confirmed bookings exist

no payments, payouts, or invoices are outstanding

no chargebacks, damage cases, or disputes are outstanding

no statutory or contractual obligations stand in the way. Existing bookings and claims already arisen remain binding until fully settled.

BeautySpaceBooking may terminate the platform agreement with immediate effect in cases of serious or repeated breaches. Statutory retention obligations remain unaffected.

The Host must inform BeautySpaceBooking without undue delay if:

the business or a location is sold or transferred

management or authority to represent changes

beneficial owners change materially

another operator takes over the beauty workspace

the authority to grant use changes or ceases. A new operator must be verified and activated by BeautySpaceBooking before takeover.

BeautySpaceBooking is liable exclusively for its own obligations under the platform agreement in accordance with the Platform Terms and mandatory statutory provisions.

BeautySpaceBooking is in particular not liable for:

the usage agreement between Host and Renter

damage to the beauty workspace or inventory caused by a Renter

theft or loss

the solvency of a Renter

missing bookings, occupancy, or revenue

false information of other users

acts of customers or accompanying persons of the Renter

disruptions of external banks, payment service providers, or other third-party providers insofar as BeautySpaceBooking is not itself at fault.

A review, verification, or activation does not constitute a guarantee or assurance.

The Host shall indemnify ID Partner GmbH against justified third-party claims arising from a legal or contractual breach for which they are responsible. This concerns in particular claims due to:

missing authority to grant use

missing permits or insurance

false or unlawful offers

safety, hygiene, or data protection violations

damage to persons or property

infringement of copyright, trademark, or personality rights

false price, tax, or invoicing information

cancellations caused by the Host

platform circumvention. The indemnification includes reasonable and necessary costs of legal defence insofar as this is permitted by law.

The Host may use personal data of a Renter only insofar as this is required for the preparation, performance, settlement, or legal documentation of the respective booking.

Use for their own advertising is permitted only with an independent legal basis. Non-public business, technical, security-related, and financial information of BeautySpaceBooking or other users must be treated confidentially. Further information is contained in the Privacy Policy of BeautySpaceBooking.

BeautySpaceBooking may be legally obliged to collect, review, retain, and transmit to competent authorities information on Hosts, beauty workspaces, bookings, income, payouts, and fees.

The Host must provide the required information completely, accurately, and within the deadline. If information is missing or cannot be verified, offers, bookings, or payouts may be restricted until clarified.

BeautySpaceBooking may amend these Host Terms for legal, technical, security-related, economic, or organisational reasons.

The Host is generally informed electronically of material amendments at least 30 days before the planned effective date.

A shorter period may apply if mandatory legal requirements, official orders, or urgent security measures require it. For already confirmed bookings, the terms and commission rates applicable at the time of booking generally apply. For material amendments, renewed active consent may be required.

Austrian law applies to the platform agreement between the Host and ID Partner GmbH, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For disputes, the exclusive jurisdiction of the competent court in Vienna is agreed insofar as permitted by law. For the usage agreement between Host and Renter, mandatory provisions of the state in which the beauty workspace is located may additionally apply. The authoritative contract language is German. Translations may be provided in English and Spanish.

In case of discrepancies, the German version prevails insofar as mandatory law does not provide otherwise. Should any provision be wholly or partly invalid, the remaining provisions remain effective. The invalid provision is replaced by the applicable statutory provisions.
